- How is The Central Educational Institutions (Reservation in Teachers’ Cadre) Bill recently passed by the Parliament is going help the reserved classes? Elucidate. (150 words)
- The bill replaces an Ordinance that was promulgated on March 7, 2019.
ALL ABOUT THE BILL
- The Bill provides for reservation of teaching positions in central educational institutions for persons belonging to:
- Scheduled Castes,
- Scheduled Tribes,
- socially and educationally backward classes
- economically weaker sections.
- The issue emerges from an April 2017 Allahabad High Court order.
- In its order, it said that for the purpose of reservation for Scheduled Caste and Scheduled Tribes in universities, an individual department should be considered as the base unit to calculate the number of teaching posts to be reserved.
- The order was challenged in the Supreme Court, which upheld the HC order.
- A review petition filed by the HRD Ministry in February this year was also dismissed by the apex court.
- This led to massive protests from teachers and students across the country as it was feared the new system would lower the numbers of reserved seats in universities.
- In March, the Cabinet cleared an ordinance on reservation mechanism for appointment of faculties in universities in order to overturn the HC and SC orders.
WHAT IF THERE IS NO BILL
- The reserved category candidates will fall behind in the recruitment process.
- E.g. If reservation is implemented at the associate professor level by taking a university as a unit, then 309 scheduled tribe candidates will get chance.
- But if it is done at the department level, then only 66 ST candidates will get a job.
AIM OF THE BILL
- According to the HRD Ministry, there are more than 7,000 teaching jobs lying vacant in central educational institutions. This Bill is aimed at filling those vacancies.
RECRUITMENT PROCESS
- According to the provisions of this Bill, teachers will be given jobs through direct recruitment. This means that the process of recruitment would be by inviting applications from those eligible to teach in a Central institution, as against public advertisement.
ARE ALL CENTRAL INSTITUTIONS INCLUDED IN THIS BILL?
- No, there are exceptions. Those institutes deemed as institutions of excellence, and of national and strategic importance will not come under this law.
- Like- Homi Bhabha National Institute, Tata Institute of Fundamental Research etc.
- Minority institutions are also left out of this Bill.
