ARTICLE 370 OF THE CONSTITUTION OF INDIA

  •  On 5 August 2019, President Ram Nath Kovind issued a constitutional order revoking the 1954 order, and making all the provisions of the Indian constitution applicable to Jammu and Kashmir.
  •  Following resolutions passed in both the houses of Parliament, he issued a further order on 6 August declaring all the clauses of Article 370 to be inoperative.

 JAMMU AND KASHMIR REORGANISATION ACT, 2019

  • The Jammu and Kashmir Reorganisation Act, 2019, is an act of the Parliament of India.
  • It contains provisions to reorganise the State of Jammu and Kashmir into two union territories, one to be called Jammu and Kashmir, and the other Ladakh on 31 October 2019.

DETAILS OF THE ACT

  • The Jammu and Kashmir Reorganisation Bill proposes to reorganise the State of Jammu and Kashmir into two Union Territories, the Union Territory of Jammu and Kashmir, and the Union Territory of Ladakh.
  • The former will have a legislative assembly whereas Ladakh will be administered by a Lieutenant Governor alone. The Union Territory of Ladakh will include the districts of Leh and Kargil. All other districts will remain with Jammu and Kashmir.

 UNION TERRITORY OF JAMMU AND KASHMIR

  • It will have a legislative assembly of 107 to 114 members, whose tenure will be five years.
  • The legislative assembly may make laws for any of the matters in the State List except “public order” and “police”, which will remain the preserve of the Union government.

DELIMITATION

  • The Election Commission (EC) held “internal discussions” on the Jammu and Kashmir Reorganisation Act 2019, in which Chief Election Commissioner (CEC) Sunil Arora and his colleagues Ashok Lavasa and Sushil Chandra were briefed by senior officers on the new law, especially its provisions on delimitation of the state’s assembly seats.

 THE NUMBERS

  • Delimitation means the act or process of fixing limits or boundaries of Lok Sabha and state Assembly seats. Population is the basis of redrawing of boundaries and allocation of seats. This task is assigned to a four-member Delimitation Commission of which one of the members represents the EC

THE NUMBERS

  • According to Section 60 of the J&K Reorganisation Act, “The number of seats in the Legislative Assembly of Union Territory of Jammu and Kashmir shall be increased from 107 to 114”.
  • Before the state’s bifurcation, Kashmir region had 46 seats followed by Jammu region with 37 and Ladakh with four. The remaining were to represent Pakistan-occupied Kashmir (PoK)

NOTES

  • The exercise of delimitation will be carried out in J&K after over two decades. Although the rest of the country had undergone delimitation in 2002, J&K Assembly had passed a law putting a freeze on fresh delimitation of seats until 2026.
  • The Delimitation of Jammu and Kashmir will be done according to 2011 census
