No Confidence Motion Accepted I Latest Burning Issue

PM MODI FACING NO-CONFIDENCE MOTION AHEAD OF 2019 POLLS

  •  Speaker Sumitra Mahajan admitted the motion of no confidence against the Modi government.
  • The trust vote will happen on Friday.
  •  A day-long debate will happen in the Lok Sabha before the vote on Friday. BJP has issued a three-line whip to its MPs, has asked allies to dothe same.
  •  Trinamool Congress has also issued a whip. But, it has sought a change of voting date.
  • UPA Chairperson Sonia Gandhi said, ‘Who says we don’t have the
    numbers?’

WHAT IS A NO-CONFIDENCE MOTION?

• According to the rules of the Indian Parliament, a government
must always have majority support in the Lok Sabha in order
to remain in power.
• If a member of the house feels that the government does not
enjoy this majority, then they can move a ‘no-confidence’
motion. If the motion is accepted, then the onus is on the
government to defeat the motion in order to prove its
majority in the house.

WHO CAN PROPOSE A NO-CONFIDENCE MOTION?

• As per Rule 198 of the Rules of Procedure and Conduct of Business in Lok Sabha, any member of the house can move ano-confidence motion.
•The member has to give a written notice of the motion by 10 am to the Secretary General of the Lok Sabha on any day of sitting. If a notice is received after 10 am, then it considered as
being received on the next day of sitting.
• The member does not need give a reason for moving a noconfidence motion
WHAT IS A NO-CONFIDENCE MOTION?
• Once the Speaker is of the opinion that the motion is proper, then s/he reads out the motion to the house.
• A minimum of 50 members have to accept the motion.
• If not, then the motion fails and the member who moved the motion is informed about it. WHAT IS A NO-CONFIDENCE MOTION?
• Vote – The motion is then put to vote; it can be conducted through “Voice Vote”, “Division of Votes” or other means.
• The government of the day has to resign if the government loses a ‘confidence’ motion or if the ‘no-confidence’ motion is accepted by the majority.
• There is no time-limit that must be adhered to between two no-confidence motions.

HISTORY
• Acharya Kripalani moved the first-ever no confidence motion on the floor of the Lok Sabha in August 1963, immediately after the disastrous India– China War. (Failed)
• Prime Minister Indira Gandhi faced the most number of no-confidence motions – 15 times
• With the anti-defection law, the vote of no-confidence has no relevance left in case the majority party has an absolute majority in the House. If the majority party (with an absolute majority in the House) issues a whip to party members to vote in favor of the Government, then it is impossible to remove the Government by a no-confidence motion.
NUMBERS
• In a House of 535 members, the ruling National Democratic
Alliance has 313 members in the Lok Sabha, including 274
(including the Speaker) of BJP, 18 of Shiv Sena, six LJP and four SAD.
The stated strength of the Opposition is 222, including 63 of the
Congress-led UPA, 37 of AIADMK, 34 of TMC, 20 BJD, 16 TDP and 11 TRS.
• Shiv Sena leader Sanjay Raut had said the party was undecided on
supporting the no-confidence motion that the TDP sought to move
in Parliament. The comments from Raut, whose party shared testy
ties with the BJP, came a day before the beginning of the
Parliament’s Monsoon Session.
