  • From September 1, 2019, new provisions of the Motor Vehicles Amendment Act 2019 became applicable.

RIGHTS OF THE DRIVER

  • Traffic police has to carry a challan book or e-challan machine if he penalises you.
  • As per section 130 of the Motor Vehicle Act, you have to produce documents and not handover the documents to the police.
  • You can politely ask for identity card of the Police officer. If he refuses, then you are entitled to not display the documents.
  • Circular released by the Ministry of Road Transport dated 17.12.2018, documents like DL, RC, Insurance and PUC can be shown to traffic police in the electronic form. (mParivahan)
  • If traffic police detains a person, he needs to be produced before the magistrate in less than 24 hours.
  • If you are being harassed by traffic police then you can file an official complaint.
  • The challan should include all the offence that a driver has committed.
  • In case of drink and drive, talking on the phone while driving, or jump the red light Traffic police can detain the driving license.
  • The traffic police officer has to provide a valid receipt if he has detained your driving license.
  • If you are driving without DL or RC, Traffic police can detain the vehicle also.
  • Traffic police cannot tow your car if you are sitting in it.

SHORTCOMINGS

  • It does not talk about the enforcement and does leave out loopholes.
  • Concerns have been raised if increasing the fines is the only way to go.
  • Issue with the infrastructure itself that is yet to be standardised across the country. (sign boards etc.)

SUGGESTIONS

  • Don’t simply argue with the traffic police.
  • You can politely explain your situation if its emergency.
  • If you have violated the traffic rules its better to pay the fine Please stop corruption.
